These General Terms and Conditions (“Terms”) apply to the use of the website www.hairbornproducts.nl (“Website”) and to all orders placed through our Website. By using the Website or placing an order, you agree to these Terms.

These Terms apply to every visitor of the Website and to every order you place with us.

By using the Website or placing an order, you agree to these Terms.

2. Amendments

We may amend these Terms at any time. The most current version will always be available on the Website.

Use of the Website after an amendment implies your agreement to the new Terms.

3. Registration & account

By creating an account, you declare that:

  • you are 18 years or older;

  • all provided data is correct and current;

  • you are not creating an account with fraudulent or misleading intent.

You are responsible for keeping your login details confidential.

We handle your personal data with care.

Our privacy policy describes how we handle your data.

By using the Website, you agree to this.

5. Security & fraud prevention

To prevent payment fraud, we may:

  • verify data via external databases;

  • request additional information;

  • cancel orders if fraud is suspected.

By agreeing to these Terms, you consent to such verifications.

6. Use of the Website

You may only use the Website for legal purposes.

7. Product information & safety warnings

Our products are cosmetic products, intended exclusively for external use on the scalp.

Our products are not medical products, not medicines, and not medical treatments.

They are not intended to diagnose, treat, cure, or prevent diseases.

Do not use the product:

  • on damaged, irritated, or inflamed skin;

  • if you are allergic to (any of) the ingredients;

  • in or around the eyes;

  • in combination with medical scalp treatments unless approved by a doctor;

  • in any way other than as prescribed in the instructions for use.

Stop use immediately if irritation, pain, or allergic reaction occurs.

8. Disclaimer product results

Hair loss has many causes (genetic, hormonal, lifestyle, stress, health, medication).

Therefore:

  • We do not guarantee results, hair growth, or reduction of hair loss.

  • The serum is a cosmetic care product, not a medical treatment.

  • Results vary by person and depend on factors beyond our control.

  • The only way to know if it works for you is to use the product consistently as prescribed.

We make no medical claims, and our product does not replace a doctor.

9. Orders

An order is an offer from you to us.

The agreement is concluded when:

  1. your payment has been accepted, AND

  2. the order has been shipped.

We may cancel orders in case of:

  • clearly incorrect price display;

  • suspicions of abuse or fraud;

  • technical errors;

  • orders that appear intended for resale.

 

10. Prices & payments

 

  • All prices include VAT.

  • We accept iDEAL, credit card, PayPal, Klarna, among others.

  • In case of an incorrect price, we may cancel the order.

  • Discount codes are only valid under the specified conditions.

 

11. Delivery & transfer of risk

  • Delivery is made via PostNL, DHL, DPD, or similar carriers.

  • Delivery times are indicative.

  • Risk of loss transfers upon receipt.

  • Incorrectly entered address details are the customer's responsibility.

 

12. Right of withdrawal & return policy (14 days)

You have a 14-day cooling-off period after receiving your order, unless:

  • the seal of cosmetic products has been broken (hygiene requirement);

  • the derma-roller has been unpacked or used.

Unopened and sealed products can be returned within 14 days.

13. Growth or Money Back Guarantee

Our guarantee is a voluntary service and is separate from the statutory right of withdrawal.

Conditions:

1. Consistent use:

You have used the serum as prescribed for a realistic period of at least 5 months (approx. 5 bottles).

2. Proof of use:

You must have taken a clear photo each month:

  • same lighting;

  • same position/angle;

  • visible treated area.

    These photos must serve as continuity for evaluation.

3. Information to be submitted:

  • All monthly photos;

  • Order numbers;

  • Brief substantiation of your experience.

4. Misuse:

In case of misuse or insufficient evidence, the application may be refused.

5. Payout:

Upon approval, you will receive the purchase price of the used products back.

14. Subscriptions 

By entering into a subscription, you authorize automatic debits at the chosen interval until the subscription is paused or cancelled.

You can pause or cancel your subscription at any time via your account. To avoid charges for a subsequent period, the change must be implemented before the renewal date.

Failed debits may be re-presented automatically.

Any price changes apply only to future renewals and will be communicated in advance, unless mandatory law dictates otherwise.

15. Discount codes & promotions

Discount codes:

  • are not always combinable;

  • may expire;

  • may be refused in case of misuse.

Promotions can be changed or discontinued at any time.

16. Derma-roller use & liability

Our derma-roller is a cosmetic aid.

Use:

  • max. 1x per week;

  • never share with others;

  • not on wounds, acne, or inflammation;

  • always disinfect after use.

If you use the roller incorrectly, Hairborn® is not liable for damage.

 

17. Liability & limitations

To the extent permitted by law, we exclude liability for:

  • indirect damage;

  • consequential damage;

  • damage due to incorrect use;

  • damage due to incorrect address details;

  • damage caused by not following instructions for use.

Our maximum liability is limited to the purchase amount.

We do not exclude liability for:

  • death or personal injury due to our negligence;

  • fraud;

  • situations where exclusion is legally prohibited.

 

18. Force majeure

We are not liable for delays or damages due to circumstances beyond our control, such as:

  • transport problems;

  • IT failures;

  • strikes;

  • pandemics;

  • natural disasters.

19. Intellectual property

All intellectual property rights to the Website and the content used thereon (such as texts, logos, images, product names, and designs) belong to Hairborn Products V.O.F. or its licensors.

Hairborn® is a registered trademark.
The Hairborn® trademark is registered in the Benelux Trademark Register at the Benelux Office for Intellectual Property (BOIP). Hairborn® has the exclusive right to use this trademark for the registered products and services.

Without prior written permission, it is not permitted to use the Hairborn® trademark or confusingly similar signs, nor to copy or commercially exploit content from the Website.

20. User-generated content & reviews

When you post content (reviews, photos, comments), you grant Hairborn® a:

  • perpetual,

  • royalty-free,

  • worldwide,

  • sublicensable right of use.

We may modify, refuse, or remove content if it violates the Terms.

21. Links to third parties

We are not responsible for websites to which the Website refers.

Use is at your own risk.

22. Referral program

Participation in our referral program means:

  • credit is not redeemable for cash;

  • only for new customers;

  • misuse leads to removal of credit.

 

23. Disputes & applicable law

These Terms are governed by Dutch law.

Disputes will exclusively be submitted to the competent court in Amsterdam.

24. Other provisions

  • If a provision proves invalid, the remaining provisions remain valid.

  • Our failure to immediately enforce a provision does not mean we waive it.

  • These Terms constitute the entire agreement between you and Hairborn®.
